
The Delhi High Court is set to convene on April 29 on a serious topic. The HC will deliberate over a petition for disqualification of PM Narendra Modi from contesting elections. It’ll stop the PM from contesting elections for a duration of six years.
The plea was put forward by Anand S Jondhale, a practicing lawyer. It alleges that PM Modi unlawfully sought votes for the Bharatiya Janata Party (BJP) by invoking Hindu and Sikh deities and their sacred places.
Jondhale’s petition urges the Election Commission of India (ECI) to take action under the Representation of Peoples Act. The petition is calling for PM Modi’s disqualification and a prohibition on soliciting votes in the guise of religious entities or sites.
The catalyst for this legal challenge was PM Modi’s address on April 9 in Uttar Pradesh. There, he purportedly referenced Hindu and Sikh icons to sway electoral support. He also made disparaging remarks against opposition parties in relation to Muslims.
According to Jondhale’s contentions, PM Modi’s speeches, made during official government aircraft and helicopter travels across India, possess the potential to incite animosity among voters along religious and caste lines.
The petitioner has been pursuing action against the Prime Minister under the Model Code of Conduct. It argues that the ECI’s inaction could compromise the integrity of impending Lok Sabha polls.
Earlier this month, Jondhale submitted a complaint to the ECI. It demanded an FIR against PM Narendra Modi under Section 153A of the Indian Penal Code and advocated for his disqualification from elections for six years under the Representation of the People Act, 1951.
Nonetheless, the petitioner expressed dissatisfaction with the ECI’s purported lack of action in addressing these grievances, emphasizing the urgency of electoral rectitude.
The forthcoming hearing at the Delhi High Court signifies a pivotal moment in the legal battle. As it involves the disqualification of PM Narendra Modi, it’s an important matter. Jondhale’s efforts underscore a broader discourse on the permissible bounds of political rhetoric during campaign season and the responsibilities of incumbency.
