The term “workplace harassment” describes undesirable conduct or acts that compromise employees’ safety and dignity by fostering a hostile work environment. Cyberbullying, physical threats, psychological manipulation, verbal abuse, and sexual approaches are just a few of the ways that harassment may manifest itself. These behaviours damage relationships in the workplace and harm people’s emotional and physical health.

Types of Workplace Harassment

Workplace harassment encompasses a wide range of behaviours, and it is essential to recognize its various types for effective intervention.

Verbal Harassment:

This category involves belittling slurs, offensive jokes, or unjust criticism. Subtle actions, such as body-shaming or sarcastic comments, often go unnoticed yet can lead to enduring impacts on the victim.

Psychological Harassment:

Psychological harassment is often hidden and includes behaviours such as isolating an employee, withholding essential information, or giving unreasonable tasks. These actions can result in diminished self-esteem, increased stress, and mental health challenges.

Cyberbullying:

As reliance on digital communication grows, cyberbullying has emerged as a prevalent form of harassment in the workplace. This can involve sending threatening messages via email, posting disparaging remarks on social media, or impersonating someone online to damage their reputation.

Sexual Harassment:

Sexual harassment consists of unwanted physical advances, inappropriate remarks, or requests for sexual favours. This is among the most frequently documented types of harassment, yet it remains significantly underreported due to social stigma.

Physical Harassment:

This includes inappropriate touching and physical assaults. Gender minorities and LGBTQIA+ individuals often face a heightened risk of experiencing such harassment.

Legal Framework Addressing Workplace Harassment in India

India has put strong legislative measures in place to prohibit harassment at work, with a special emphasis on sexual harassment.

The Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013 (PoSH Act):

The PoSH Act serves as thorough legislation aimed at tackling sexual harassment within workplaces. Key elements include:

  • Definition of Sexual Harassment: Encompasses unwanted physical contact, sexual propositions, lewd remarks, and inappropriate gestures.
  • Internal Complaints Committee (ICC): Employers with a workforce of 10 or more must set up an ICC to handle complaints.
  • Preventive Measures: Employers are required to promote awareness, display their policies against harassment, and guarantee a secure work environment.
  • Redressal Mechanism: Individuals affected can lodge complaints with the ICC, which possesses authority similar to civil courts for collecting evidence.
  • Penalties: Failure to comply may lead to fines or revocation of business licenses.

Indian Penal Code (IPC):

Various sections of the IPC tackle the issue of harassment:

Section 354: Provides protection for women against assaults aimed at violating their modesty, with penalties including imprisonment or fines.

Section 354A: Specifically addresses sexual harassment, including unwelcome physical contact, demands or requests for sexual favors, or showing pornographic material.

Section 509: Punishes words or actions meant to insult a woman’s modesty.

Equality Laws:

Article 14 (Equality Before Law): Ensures equal protection under the law for everyone.

Article 15 (Prohibition of Discrimination): Prohibits discrimination based on religion, race, caste, sex, or place of birth.

Article 21 (Right to Life and Personal Liberty): Guarantees dignity and safety for every individual.

Steps to Combat Workplace Harassment

For Employers:

  • Develop Anti-Harassment Policies: Create explicit guidelines that define unacceptable behaviour and the penalties for infractions.
  • Awareness and Training Sessions: Hold regular workshops to inform employees about harassment issues and the mechanisms for reporting them.
  • Proactive Culture Development: Cultivate a workplace atmosphere that values diversity and fosters mutual respect.
  • Open Complaint Channels: Ensure that grievances are addressed quickly, confidentially, and thoroughly.

For Employees:

  • Record Incidents: Maintain detailed documentation of harassment occurrences, noting dates, times, and any witnesses.
  • Utilize Witness Support: Gather support from coworkers who may have witnessed the inappropriate conduct.
  • Report Issues Professionally: Present a clear and well-documented complaint to the HR department or Internal Complaints Committee.
  • Follow-Up: If there is a lack of response, escalate the issue to external authorities or seek legal advice.

Challenges in Tackling Workplace Harassment

Underreporting:

Many individuals refrain from reporting incidents due to fears of retribution or being stigmatized.

Cultural Stigma:

Societal views often discourage open conversations about harassment, especially sexual harassment.

Insufficient Awareness:

Both employees and employers may lack knowledge regarding their legal rights and responsibilities.

Weak Implementation:

Although legal frameworks exist, adherence to these laws can be inconsistent, particularly in smaller businesses or unregulated industries.

In India, workplace harassment is a serious problem that has a big impact on both people and businesses. Strong redressal procedures are offered by legal remedies such as the PoSH Act and IPC rules, but their effectiveness depends on knowledge, preventative actions, and cultural shift. Establishing a harassment-free workplace must be a top priority for employers, and staff members should feel free to voice their concerns. When combined, these initiatives may guarantee that workplaces are inclusive, courteous, and safe for everyone.
