
In a significant ruling, the Supreme Court of India has made a significant ruling. It upheld the Gujarat HC’s promotion of judicial officers in 2023. These recommendations were put forth concerning the elevation of Senior Civil Judges to the 65% promotion quota of District Judges.

The genesis of the controversy traces back to the All India Judges’ Association and Ors. Vs. Union of India and Ors. case of 2002. There, the Supreme Court directed that recruitment to the cadre of District Judges should follow the principle of “merit-cum-seniority“.
It had to be done alongside a suitability test. Subsequently, the High Court of Gujarat framed the Gujarat State Judicial Service Rules, 2005. It mandated promotion from Senior Civil Judges to District Judges based on this principle. Now, the SC has upheld Gujarat HC’s promotion of judicial officers.
In June 2011, an amendment to the Rules enhanced the promotion quota from 50% to 65%. It emphasized merit-cum-seniority and passing a suitability test as prerequisites. However, a challenge emerged when certain judicial officers contested the promotions made under this provision. They argued a deviation from the merit-cum-seniority principle.
In its recent judgment, the SC dismissed the challenge against the merit list and vacated the stay previously imposed. The bench comprised Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Misra.
The Court clarified that the principle of “merit-cum-seniority” does not entail a comparative assessment for the 65% promotional quota. Justice Pardiwala elucidated the judgment. He emphasized that the principle aims to evaluate each candidate’s suitability and efficiency independently.
The Court stressed that the promotion process is not akin to a competitive exam. It rather focuses on determining the suitability of candidates based on their individual merit and seniority.
The Court underscored the importance of maintaining the distinction between the 65% and 10% promotion quotas. It highlighted that accepting the petitioners’ contention would blur this demarcation.
The court affirmed the validity of the promotion process adopted by the High Court of Gujarat. It emphasized its adherence to the criteria laid down in previous judgments.
